This is the Privacy- and Cookie Statement (“Statement”) of DataLane B.V. (“DataLane”), a limited liability company duly incorporated under the law of the Netherlands (hereinafter “we” or “us”). This Statement explains how we deal with personal information that we process. We respect the privacy of our customers and business relations and ensure that any personal information that we process will be protected and treated confidentially.

Whose personal data do we process?

As a service provider we process personal data. This includes personal data of:

  1. Applicants or other persons who contacted us regarding a job or internship (hereinafter: "Applicants");
  2. Persons who are customers of DataLane or who are employed by our customers (hereinafter: "Customers");
  3. Visitors to our website (hereinafter: "Website Visitors");
  4. Persons who subscribed to our newsletter and/or direct marketing communications (“Subscribers”);
  5. Third parties, such as vendor, contractors and/or experts with whom we cooperate (hereinafter: "Third Parties").

What personal data do we process? For what purposes and on what legal basis?

Applicants

We process the following personal data of Applicants:

  1. Contact details (such as name and address details, telephone numbers, e-mail addresses and social media), date of birth, place of birth, nationality and gender;
  2. Job related experience (such as education followed, previous work experience);
  3. Other data that may be relevant for the performance of the position to which the application has been made (such as data mentioned in a job application or cover   letter, references, or results of a competency test);
  4. Possibly: bank details (such as bank account number and name of the account holder);
  5. Other data of which the processing is required pursuant to, or necessary for, the application of laws or regulations.

Do we share personal data with third parties?

We do not share personal data of Applicants with:

  1. Third parties we engage for the recruitment of staff or to lead the application process;
  2. Others, with the Customer's consent, or if there is a legal obligation.

We may share personal data of Customers and their employees with:

  1. Vendor or partners we engage to offer our services;
  2. Others, with the Customer's consent, or if there is a legal obligation.

We may share personal data of Website Visitors with:

  1. Vendors, for example the party that keeps track of the usage statistics of our website; and
  2. Others, with the permission of the Website Visitor, or if there is a legal obligation.

We may share personal data of third parties with:

  1. Customers or other Third Parties, in the context of providing our services;
  2. Others, with the consent of the Third Party, or if there is a legal obligation.

If we share personal data with a third party, we will, if necessary, conclude a (processor) agreement with this third party, which meets all the requirements of the General Data Protection Regulation. We do not provide personal data to third parties for commercial purposes.

Do we transfer personal data outside the European Economic Area?

Sometimes we must transfer personal data to a country outside the European Economic Area (EEA). If such a situation arises and your personal data is transferred to a country which provides a lower level of protection for your personal data than the General Data Protection Regulation, we will put in place appropriate safeguards to protect your personal data, such as the conclusion of a model contract with the recipient of the personal data approved by the European Commission.

What security measures do we apply?

When processing personal data, we always maintain a level of security which, given the state of the art and the cost of implementation, is appropriate, among other things, to prevent unauthorised access, modification, disclosure, loss, or any other form of unlawful processing of personal data.

We maintain at least the following security measures:

  1. Physical access control (locks, alarm system)
  2. Organizational access control (authorization policies, usernames and passwords, confidentiality clauses)
  3. Technical access control (virus scanner, spam filters, firewall, security of the website by means of an SSL certificate)
  4. The pseudonymization and encryption of personal data
  5. A procedure for testing, assessing, and evaluating at regular intervals the effectiveness of the technical and organizational measures to secure the processing.

What rights do you have regarding the personal data we process?

You have the right to request us to inspect (including a copy), rectify and/or delete your personal data, restrict the processing in question, as well as the right to object to the processing or to request the transfer of the personal data you have provided to us. To prevent misuse, we may ask you to identify yourself adequately before we process your request. Circumstances may arise because of which we cannot, or cannot fully, comply with your request. Examples are statutory retention periods. If such a circumstance arises, we will report it to you. In principle, we will respond to your request within one month of receipt.

For how long do we store personal data?

We will retain your personal information no longer than is necessary for the purposes for which they are processed unless the data should be kept longer to comply with legal obligations.

Do we use cookies on our website?

A cookie is a small text file that is sent along with a page of the website and is stored via your browser on the hard drive of your computer, tablet, or phone. This allows personal data to be collected. The website of DataLane uses the cookies below.

Functional cookies

We use cookies to remember your chosen settings and entered data, so that your use of the website on a subsequent visit is facilitated.

Analytical cookies

We use Google Analytics; a service of Google Inc. Google Analytics is a web analysis service that uses cookies to analyse how you use the website. The cookies are used to store visitor information, such as the time at which the visit to the website took place, whether the Website Visitor has visited the site before, and via which site the Website visitor ended up on our site.

We have set up Google Analytics in such a way that tracking on an individual level is technically impossible. For example, the last octet of the IP address of a Website Visitor is masked. We have also turned off 'data sharing', no use is made of other Google services in combination with Google Analytics and we have concluded a processing agreement with Google in which agreements have been made about the processing of the personal data of Website Visitors.

Marketing cookies

We use marketing cookies to track Website Visitors across multiple websites, so that third parties can display relevant advertisements. Because these cookies are often placed by third parties, we recommend that you always read the cookie statements of these third parties before accepting cookies.

Refusing and deleting cookies

You can decide for yourself whether you want to accept or refuse cookies or whether you want your browser to notify you when a cookie is placed. To do this, you need to adjust the settings in your browser.

You always have the option to delete cookies that have already been placed from the hard drive of your computer, tablet or phone. In addition to refusing cookies via your browser, you can also install the Google Analytics Opt-out Add-on in your browser. This prevents Google Analytics from collecting information about your website visits.
